Distance Sales Agreement

1. PARTIES
This Agreement is signed between the following parties under the terms and conditions set forth below.

A. ‘BUYER’; (hereinafter referred to as “BUYER”)
By accepting this Agreement, the BUYER acknowledges that upon confirming the order, they will be obligated to pay the order price and any additional fees, such as shipping and taxes, and that they have been informed of this obligation.

B. ‘SELLER’ Şeyma Ateş; (hereinafter referred to as “seymaates.com”)

2. DEFINITIONS
In the application and interpretation of this Agreement, the following terms shall refer to the written explanations they contain.
MINISTER: The Minister of Customs and Trade,
MINISTRY: The Ministry of Customs and Trade,
LAW: Law No. 6502 on Consumer Protection,
REGULATION: Regulation on Distance Contracts (Official Gazette: November 27, 2014/29188)
SERVICE: The subject of any consumer transaction other than the provision of goods made or promised for a fee or benefit,
SELLER: A company that offers goods to consumers within the scope of its commercial or professional activities, or acts on behalf of or on behalf of those offering goods,
BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
WEBSITE: The SELLER’s website,
ORDERER: A natural or legal person who requests a good or service through the SELLER’s website,
PARTIES: SELLER and BUYER,
CONTRACT: This agreement between the SELLER and BUYER. Contract;
GOODS: The movable goods subject to the transaction, as well as software, audio, video, and similar intangible goods prepared for use in an electronic environment.

3. SUBJECT
This Agreement governs the rights and obligations of the parties in accordance with the provisions of Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of the product, the specifications and sales price of which are specified below, ordered electronically by the BUYER through the seymaates.com website.
The prices listed and announced on the website are the sales prices. The announced prices and promises are valid until updated or changed. Prices announced periodically are valid until the end of the specified period.

6. CONTRACTUAL PRODUCT(S) INFORMATION
6.1. The basic characteristics of the goods/products/services (type, quantity, brand/model, color, and number) are published on the seymaates.com website. If a campaign is organized by seymaates.com, you can review the basic characteristics of the relevant product during the campaign period. These are valid until the campaign date.

6.2. The prices listed and announced on the website are the sales prices. The advertised prices and promises are valid until updated or changed. Prices announced for a limited period are valid until the end of the specified period.

6.3 Installment commissions are included in the total price. Installment payment is provided by the installment payment infrastructure.

6.4. The sales price of the goods or services subject to the contract, including all taxes, is shown below.

7. DELIVERY AND DELIVERY COSTS

7.1. Delivery of the goods will be made within the agreed timeframe after payment. The Seller shall deliver the goods or services within 30 (thirty) days of the Buyer’s order, save for circumstances where the fulfillment of the ordered goods or services becomes impossible.

7.2. If, for any reason, the Buyer does not pay for the goods or services, or if the payment made is cancelled in the bank records, the Seller is deemed to be relieved of its obligation to deliver the goods or services.

7.3. Unless otherwise stipulated, the delivery costs of the goods are the responsibility of the Buyer. If the Seller has declared on the Website that it will cover the delivery costs, the delivery costs will be the responsibility of the Seller. If the shipping cost is collected from the BUYER, the SELLER will deliver the goods to the courier company, sender paid, as part of the total price.
